What Are Non-Traded REITs and Their Risks That Can Lead To Losses for Colorado Investors?

A non-traded real estate investment trust owns, runs, and/or finances mostly income-producing real estate assets. Although regulated by the Securities and Exchange Commission (SEC), non-traded REITs are unlisted and not traded on any open exchange.

This type of real estate investment allows investors, including retail investors that satisfy certain state-mandated requirements, a chance to get involved in assets to which they might not normally have access while, supposedly, allowing them to reduce or eliminate certain taxes. However, investing in a non-traded real estate investment trust does come with risks. Here are some of them:

  • Because blind pool acquisitions might be a factor, it can be hard for an investor to know what properties are involved.
  • Early redemptions can lead to high fees that may reduce an investor’s total return.
  • Front-end fees can be as high as up to 15%.
  • There is a limited secondary market for reselling a non-traded REIT investment.
  • A non-traded REITs can be illiquid for years.
  • Any steady income from this type of alternative investment might not happen for a while.
  • Shareholder distributions may have to be subsidized by borrowed money and they are not guaranteed.

A lot of non-traded REITs are set up with a finite time frame for when they either have to become listed on a national exchange or must liquidate. Losses could result for an investor if the latter occurs.

What Role Does Broker Fraud Play In Non-Traded REIT Losses?

If your financial advisor unsuitably recommended a non-traded REIT, failed to fully apprise you of the risks, made misrepresentations and omissions about this investment, neglected to conduct the necessary due diligence, breached their fiduciary duty to you, overconcentrated your account with too many risky investments, or were negligent or grossly negligent, you may be able to sue for damages.

Broker-dealers are supposed to properly oversee customers’ accounts and their registered representatives’ activities as they manage an investor’s portfolio. Failure to supervise any of that can also be a reason for financial recovery.
